HIKITALO HEALTH & SAFETY WAIVER AND RELEASE OF LIABILITY
Please Read Carefully Before Signing
This Health and Safety Waiver and Release of Liability ("Waiver") is a binding agreement between the undersigned individual ("Participant") and Hikitalo Ltd ("Company"). By signing this Waiver, the Participant acknowledges and agrees to the following terms and conditions:
1. Acknowledgment of Health Risks
1.1 The Participant understands that the use of wood-fired sauna services and cold plunge facilities (including sea dipping and cold showers) involves exposure to extreme temperatures, which may pose risks including but not limited to:
- Dizziness
- Fainting
- Cardiovascular issues
- Respiratory distress
- Muscle cramps or other physical injuries
- Hypothermia or cold shock (from cold water exposure)
1.2 The Participant certifies that they have consulted with their physician if they have any concerns, and have no medical conditions, illnesses, or physical injuries that would make participation in these services unsafe. Conditions to consider include but are not limited to:
- Heart disease or cardiovascular conditions
- High or low blood pressure
- Respiratory issues
- Pregnancy
- Diabetes or other metabolic conditions
- History of seizures, epilepsy, or fainting
- Fungal infections, open wounds, or skin conditions
1.3 The Participant agrees to immediately inform the Company of any changes in their health or medical condition that may increase their risk.
2. Voluntary Participation
2.1 The Participant acknowledges that their participation in the sauna and cold plunge services is entirely voluntary and that they are free to withdraw at any time.
2.2 The Participant understands and accepts that there are inherent risks associated with these services, and they assume full responsibility for any injuries, health complications, or other issues that may arise during or after participation.
3. Waiver and Release of Liability
3.1 By signing this Waiver, the Participant agrees to release, discharge, and hold harmless the Company, its owners, employees, agents, and affiliates from any and all claims, liabilities, demands, or causes of action arising from:
- Personal injury
- Illness or health complications
- Property damage or loss
- Any other incident resulting from the Participant's use of the Company's services
3.2 This release includes claims based on negligence by the Company, to the fullest extent permitted by law.
4. Assumption of Risk
4.1 The Participant fully understands and voluntarily accepts all risks associated with the use of the sauna and cold plunge services.
4.2 The Participant agrees that they are solely responsible for determining their physical and mental fitness for participation and that the Company is not responsible for verifying their suitability.
5. Sea Dipping and Cold Plunge Use
5.1 The Participant acknowledges that sea dipping or use of our cold and hot plunges is at their own risk, especially at certain high tides due to submerged rocks and strong currents.
5.2 The Participant agrees to follow all staff safety instructions, including not entering the water when advised against doing so.
5.3 The Participant confirms they are prepared for cold temperatures and any risks associated with sudden exposure to cold water.
5.4 If entering the sea, the Participant confirms they are a competent swimmer and are aware of unpredictable sea conditions.
6. Sauna Usage Rules and Etiquette
6.1 The Participant agrees to abide by all sauna usage rules and etiquette, including but not limited to:
- No alcohol consumption or nudity
- Removing shoes and washing feet before entry
- Sitting on a towel at all times
- Limiting sauna sessions to 5-15 minutes at a time (maximum 20 minutes)
- Pouring water gently on stones using only designated sauna water
- Not touching the stove, cage, or rocks
- No glass containers inside the sauna
- No phone use inside the sauna
- Using only provided essential oils on sauna rocks
- Being respectful of others and maintaining a peaceful atmosphere
6.2 The Participant understands that failure to follow these rules may result in removal from the facility without refund.
7. Age Restrictions
7.1 The Participant confirms they are 16 years of age or older for social sauna sessions.
7.2 For private group bookings, children aged 6-16 may participate only when accompanied by a parent or guardian inside the sauna at a 1:1 ratio. The responsible adult accepts full responsibility for the child's safety.
7.3 All staff have the right to challenge the age of anyone attempting to participate and have full rights to refuse use without a refund.
8. Alcohol and Substance Policy
8.1 The Participant agrees not to use the sauna or cold plunge facilities while under the influence of alcohol or drugs.
8.2 Hikitalo Ltd reserves the right to refuse admission to anyone intoxicated or in breach of this policy, without refund.
9. Emergency Situations
9.1 The Participant agrees to follow all safety instructions provided by the Company's staff and to immediately alert staff in the event of discomfort, dizziness, or any other unusual symptoms.
9.2 The Participant consents to the administration of first aid and/or emergency medical treatment if deemed necessary by the Company's staff during participation.
10. Personal Property
10.1 Hikitalo Ltd is not responsible for any loss or damage to personal property.
11. Group Bookings
11.1 If booking on behalf of a group, the Participant confirms it is their responsibility to ensure all participants are aware of these terms and adhere to them.
12. Indemnification
12.1 The Participant agrees to indemnify and hold harmless the Company from any and all claims, damages, losses, or expenses (including reasonable attorney's fees) arising from their use of the services, except in cases of gross negligence or intentional misconduct by the Company.
13. Admission Policy
13.1 Hikitalo Ltd reserves the right to refuse entry to anyone who poses a risk to their own health or the safety of others.
13.2 Refunds will not be issued in cases where admission is refused due to policy violations or health and safety concerns.
14. Governing Law
14.1 This Waiver shall be governed by and construed in accordance with the laws of England and Wales.
14.2 Any disputes arising under this Waiver shall be resolved in a court of competent jurisdiction in England and Wales.
15. Severability
15.1 If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Participant Acknowledgment and Consent
By signing below, I acknowledge that I have read and understood this Waiver in its entirety. I voluntarily agree to the terms and conditions stated herein. I confirm that I am of legal age (or have parental consent if aged 6-15 for private bookings) and have the capacity to sign this Waiver.
I understand that all persons use the sauna and surrounding areas at their own risk, and that Hikitalo Ltd is not liable for any injuries sustained as a result of sauna use or cold plunges.
